Before the Data Act starts applying from 12 September 2025, the Commission will recommend Model Contractual Terms (MCTs) for data sharing, and Standard Contractual Clauses (SCCs) for cloud computing contracts. These models intend to help especially small and medium-size companies and other organisations which may lack resources to draft and negotiate fair contractual clauses for data sharing or for cloud computing.
To assist the Commission in developing these contracts an expert group was set up in 2022. They will complete their work by end of March 2025, and their report will then be published on the Register of Expert Groups. This report will form the basis for the incoming Commission Recommendation.
On 10 and 11 April 2025, the Commission will be hosting webinars with businesses, policymakers, lawyers, and experts to discuss the Expert Group’s final report consisting of their suggestions for MCTs and SCCs. The webinars are open to Member State authorities, companies, lawyers, professors, and organisations.
