Copyright in the DSM Directive: Commission launches call for tenders for a study to support the review of the Directive

The Commission has launched a call for tenders for a study to support the upcoming review of the Copyright in the Digital Single Market (DSM) Directive.

The study aims to provide DG CNECT with methodological and analytical support in gathering quantitative and qualitative information on the application of the DSM Directive and in assessing its impacts on relevant stakeholders, including rightsholders, online market players and users. The results of this study will feed into the report of the Commission, in line with Article 30(1) of the DSM Directive.

The objective of the study is to assess whether the Directive achieved its objectives, namely to;

  1. facilitate the digital use of protected content for education, research and preservation,
  2. improve licensing practices, thereby ensuring wider access to content, and
  3. ensure a well-functioning marketplace for copyright.

More specifically, the future contractor will be required to:

  1. Provide the Commission with detailed information and data on the application of the different provisions of the DSM Directive across EU Member States, collected through, inter alia, stakeholder consultations and case studies.
  2. Deliver an objective quantitative and qualitative assessment of the effectiveness of the Directive’s provisions and identify possible shortcomings.
  3. Where relevant, based on the assessment, identify areas where additional measures may be needed to improve or better achieve the Directive’s objectives.
