The targeted consultation is part of an ongoing effort to ensure the effective application of the provision across the Member States and to help their Digital Services Coordinators (“DSCs”) to monitor and supervise compliance.

Factual Summary Report on the targeted consultation on the notification of suspicions of criminal offences under DSA

The targeted consultation was conducted over a seven-week period, from 18 November 2025 to 9 January 2026.

By means of the consultation, the Commission services sought feedback from relevant stakeholders in the field with a view to:

  • obtain feedback on the functioning of the notification process to identify the areas that warrant further clarification;
  • gather good practices concerning the processing of notifications and the identification of the Member State(s) concerned whose authorities should receive the notifications;
  • identify the criminal offences considered in scope of the article under national law and practical examples of such offences.
