The European Board for Digital Services, established by the Digital Services Act (DSA), is an independent advisory group composed of Member States Digital Service Coordinators and chaired by the European Commission to ensure consistent application and enforcement of the DSA across the EU. The Board harbours 8 working groups with different competences.
Working Group 7 provides for exchanges and discussions on the cooperation with law enforcement authorities and on illegal content. In particular, this relates to orders under Articles 9 and 10 and to Article 18 of the DSA.
As part of this work, Working Group 7 led the drafting of a document outlining good practices and practical examples for the notification of suspicions of criminal offences under Article 18 of the DSA. This document was adopted by the Board on 25 September 2026. With the help of Working Group 7, the Commission also maintains and regularly updates a list of contact points for hosting service providers to notify suspected criminal offences.
