Az MI-rendszer meghatározására vonatkozó iránymutatások kiadásával a Bizottság a szabályok hatékony alkalmazásának megkönnyítése érdekében segíteni kívánja a szolgáltatókat és más érintett személyeket annak meghatározásában, hogy egy szoftverrendszer MI-rendszernek minősül-e.
Az MI-rendszer meghatározására vonatkozó iránymutatások nem kötelező erejűek. Úgy tervezték őket, hogy idővel fejlődjenek, és szükség szerint frissülnek, különösen a gyakorlati tapasztalatok, az új kérdések és a felmerülő felhasználási esetek fényében.
A Bizottság ezeket az iránymutatásokat a mesterséges intelligenciáról szóló jogszabályban meghatározott tiltott mesterségesintelligencia-gyakorlatokról szóló iránymutatások mellett tette közzé.
A mesterséges intelligenciáról szóló jogszabály, amelynek célja az innováció előmozdítása az egészség, a biztonság és az alapvető jogok magas szintű védelmének biztosítása mellett, az MI-rendszereket különböző kockázati kategóriákba sorolja, beleértve a tiltott, a nagy kockázatú és az átláthatósági kötelezettségek hatálya alá tartozó rendszereket.
Február 2-án, vasárnap megkezdődött a mesterséges intelligenciáról szóló jogszabály (MI-törvény) első szabályainak alkalmazása. Ezek közé tartozik az MI-rendszer meghatározása, a mesterséges intelligenciával kapcsolatos jártasság, valamint a mesterséges intelligenciáról szóló jogszabályban körvonalazott, az EU-ban elfogadhatatlan kockázatot jelentő tiltott MI-használati esetek nagyon korlátozott száma.
