Commission publishes assessment of Article 17(6) of Directive (EU) 2019/790

This assessment is applicable to certain new online content-sharing service providers with a small turnover.

Directive (EU) 2019/790 on copyright and related rights in the Digital Single Market (DSM Directive) introduced new rules on the use of copyright-protected content on online sharing platforms in order to foster the development of the licensing market between rightholders and online content-sharing service providers (OCSSPs). Article 17 provides for a specific regime of authorisation and liability applicable to OCSSPs. 

Article 17(6) limits the scope of the specific liability regime for certain new OCSSPs with a small turnover: OCSSPs that have been available to the public in the EU for less than three years and have an annual turnover below EUR 10 million. This Staff Working Document presents the assessment of the specific liability regime applicable to new OCSSPs with a small turnover and audience, based on what information gathered from Member States and stakeholders. 

This Staff Working Document does not provide an overall assessment of the impact of Article 17, which will need to be carried out no sooner than 7 June 2026 as part of the review of the Directive.
