Report of the workshop hosted by the European Commission on effective dispute resolution and the fundamental right to conduct a business

A group of experts from EU Member States and academics gathered on 6 July 2017 to discuss the topic of dispute resolution in cross-border business-to-business (B2B) contexts. The workshop intended to inform on the Commission's on-going work to prepare actions on unfair contracts and trading practices in platform-to-business relations, which were announced in the mid-term review of the Digital Single Market Strategy.

As part of the workshop, the Commission services specifically aimed to gather experts' views on how to design a possible dispute resolution instrument capable of meeting digital-specific challenges related to

  • need for speed & anonymity,
  • required information gathering & analytics capabilities
  • jurisdiction in the context of global ecosystems.

The event falls into the wider two-year assessment of online platforms kicked-off with the adoption of the Digital Single Market Strategy.
