Targeted stakeholder consultation on the lighter liability regime under Article 17(6) of Directive (EU) 2019/790

The Commission services are launching this targeted consultation in order to gather information from the relevant stakeholders on the application and impacts of the specific liability regime set out in Article 17(6) of Directive (EU) 2019/790 on copyright and related rights in the Digital Single Market (‘DSM Directive’).

Article 17 of the DSM Directive introduced rules applicable to online content-sharing services providers for the content uploaded by their users. Article 17(6) laid down a lighter regime for service providers available to the public in the EU for less than three years and with a turnover below EUR 10 million. 

This targeted consultation is part of the Commission’s assessment of the lighter liability regime provided in Article 17(6), as required under Article 30(1) of the Directive. 

Who can take part?

The focus of the consultation is solely on the practice and experience of the relevant stakeholders such as rightholders, collective management organisations and online content-sharing service providers that benefit from the lighter liability regime in Article 17(6).

The consultation closes on 7 June 2024.
