Target Group
The consultation is mainly aimed at NRAs and the Body of European Regulators for Electronic Communications (BEREC), in view of their direct involvement in the consultation procedure laid down in Article 7 of the Framework Directive. Input from all other interested stakeholders and third parties is very welcome.
Objective of the consultation
The aim of this consultation is to gather stakeholders’ feedback on their experience with the existing Procedural Recommendation, as well as views on the need for any clarification of procedural issues.
Under Article 32 and 33 of the Code (currently Article 7 and 7a of the Framework Directive), NRAs are required to notify the Commission, BEREC and other NRAs of their draft measures. The internal market procedures defined by these provisions aim to ensure that the regulation of electronic communications markets is consistent across the European Union.
The Commission’s initiative for a new Procedural Recommendation seeks to provide NRAs with updated and clear guidance on the form, content, time limits and level of detail of the notifications and related procedures under the Code, and based on previous experience of the Commission and regulators.

The objective of the consultation was to gather stakeholders’ feedback on their experience with the existing Procedural Recommendation. The questionnaire requests views on the need for any clarification of procedural issues related to provisions, both under the current Framework Directive and the European Electronic Communications Code that will replace the current legal framework in December 2020. This summary report takes stock of the contributions and presents the main initial results that emerge from them, focusing on the quantitative aspects of the consultation’s input.
