Article 57 of the European Electronic Communications Code (EECC or 'the 'Code) tasks the European Commission, by means of implementing acts, to specify the physical and technical characteristics, such as the maximum size, weight and, where appropriate, emission power of SAWAPs, that will be exempted from any individual town planning permit or other prior individual permits, except for environmental or historical reasons or public safety. At the same time, competent national authorities retain the power to lay down general requirements on environmental, electro-magnetic and other aspects of small cells, or networks more generally, to which operators of small cell networks remain subject.
In the light of the above, the Commission is launching today a public consultation on relevant aspects of an implementing act. The goal of the consultation is to collect concrete feedback and views that will contribute to the inception of such EU-wide regulatory measure. All the interested parties involved in issues related to this initiative are invited to provide their comments by 10 April 2019.
