The PSI Directive (Directive 2003/98/EC as amended by Directive 2023/13/EU) has been transposed in Austria by legislative measures at federal and at Länder level.

The PSI Directive forbids, as a general rule, the existence of exclusive arrangements. Exclusive arrangements refer to a situation where the right of reuse of public sector information is exclusively given to one commercial operator, e.g. a publisher. Exceptionally, such arrangements are allowed if they are necessary for the provision of a service of general economic interest.

In support of its policy, the Commission studies the economic case for opening up public sector information.

The Commission is itself a producer and holder of public sector information, which can be reused in added-value information products. It seeks to set an example by applying an 'Open Data' policy with respect such content, encouraging the reuse of documents.

The eTen programme supported the deployment of trans-European e-services in the public interest. eTEN programme covered the following themes: eGovernment, eHealth, eInclusion, eLearning and Services for SMEs. The eTEN programme finished at the end of 2006.
