Regulatory Framework for Video Games

Key actors and stakeholders from the video games ecosystem met for the 5th workshop organised by the European Video Games Society.

Workshop 5, Regulatory Framework for Video Games; 12 July 2022; online. 32 stakeholders joined the fifth workshop of the European Video Games Society, an initiative of the European Commission to support the video games ecosystem. The project, run by consultant companies Ecorys and KEA, aims to inform policy making on the impact of video games in various areas, identify ways for the EU to actively support the sector, and foster an active community in the ecosystem. The fifth workshop focuses on the regulatory and policy framework for video games. KEY POLICY DEVELOPMENTS (Belgium): The extension of the tax shelter scheme is to become video games sector-specific. Further work and support are still needed from the Belgian federal government and the EU. (Germany): State aid to help Germany to become the future powerhouse of video games production. A strategy of EUR 50 million federal funding for games is foreseen, including future implementation regarding location marketing, formation of hubs, technological innovation and e-sports. STATE AID AND TAX INCENTIVES: Video games should be recognized as a form of cultural asset and supported as such. Support schemes for video games can draw inspiration from support for cultural and creative industry. Sufficient state aid and tax incentive can attract talent and improve EU’s cultural competitiveness. A clear and instructive funding application system is necessary to engage the local ecosystem. VIDEO GAMES, COPYRIGHT AND IP LAW: Video games are established, influential forms of cultural creation and entitle comprehensive IP protection. Recent IP reforms lack specification for the video games sector. IP law and copyright system needs to be in accordance with the DSM Copyright Directive. Video games should be better protected as European digital heritage. HARMONISED RULES – VIDEO GAMES IN A EUROPEAN SINGLE MARKET: Regulatory framework for video games needs to be harmonized across the EU. A comprehensive and sector-specific regulatory framework helps attracting talent to the European market. Regional differences in the development of IP and other regulatory aspects need to be addressed. The importance to look beyond the European Single Market and strategically put the EU in a competitive position in the global market.
